In Indiana, grandparents can petition for visitation rights with their grandchildren. To be eligible to petition, one of the following must apply:



  1. the child’s parents are divorced,
  2. the child’s parents are separated, and paternity has been established
  3. one of the child’s parents has passed away. 


Pursuant to Indiana law, parents have the constitutional right to raise their children as they see fit. This includes deciding who is involved in their children’s lives. When faced with a petition for grandparent visitation, the Judge must weigh the rights of the parents against those of the grandparents and consider what is in the “best interests of the child”.
